A TEENAGE babysitter has been jailed after having consensual sex with a 14-year-old girl.

David Flemming, aged 19, of no fixed address, pleaded guilty to having sexual intercourse with the minor after agreeing to look after her while her aunt went out into Warrington town centre with her friends.

Prosecutor David Jones said: “She (the girl) was staying with her aunt. She (the aunt) saw him in the street at about 11pm and she mentioned to David that she wanted to go out to town and he agreed to look after the girl (who cannot be named for legal reasons).”

Mr Jones told the court the pair ordered pizza after the aunt left the house at around midnight.

The girl went to bed and was followed upstairs by the defendant who asked her for sex continually before touching her.

Warrington Crown Court heard on Friday that the girl kept refusing but then agreed to have unprotected sex with Flemming.

When questioned after the incident, Flemming said: “She came on to me. She had been trying to sleep with me for ages.”

He said that he hadn’t realised that she was under 16. Judge Elgan Edwards rejected these claims.

When the aunt returned at 3am she found Flemming and her niece clothed in bed.

Flemming accepted that he had intercourse with the girl on no more than two occasions.

Andrew Downie, representing Flemming, said that his client was very immature for his age and had a difficult background.

He said: “He is on a (prison) wing with older, more serious sexual offenders.

“The time he has spent in custody has been extremely difficult for him.”

Jailing Flemming for a year, Judge Elgan Edwards said: “You have an unimpressive record.

“The girl in question was only 14. Girls should be protected. I’m afraid it’s got to be custody but I keep it very much below the guidelines.”

Flemming had 11 previous convictions for 27 offences that were mainly related to dishonesty.

He will not be allowed to work with children unless informed otherwise and has signed the sexual offenders register.
