A PLANNING battle between the council and a Stockton Heath restaurant over a retractable roof continues to rumble on.
In April planning officers served Piccolino, on London Road, an enforcement notice ordering it to remove its first-floor roof featuring two parasols.
The restaurant lodged an appeal and a decision was expected in September, however, the council has confirmed the matter is still with the Planning Inspectorate.
A spokesman added: "A site visit with the Planning Inspectorate and the appellant is scheduled for early December and the decision is expected soon after that."
