A PETITION has been created to alter legislation to fit what has been called 'Brianna's Law.'

Brianna Ghey was murdered on Saturday, February 11 - her body was discovered in Culcheth Linear Park at approximately 3.13pm.

Brianna was 16 years old when she was brutally murdered.

She was from Birchwood and was also a member of the LGBTQ+ community, as she was trans.

Now, a petition has been created online that would see the Gender Recognition Action (2004) amended, with some taking to social media to name the proposed amendment Brianna's Law.

When a trans person wishes to change their gender legally, they must obtain a Gender Recognition Certificate (GRC).

It is understood that Brianna did not have a GRC at the time of her death, and on her death certificate it is expected that her gender will be listed as her birth gender.

The petition was created on Wednesday, February 15, and is an official petition on the Parliament.uk website.

It is titled 'Amend the Gender Recognition Act to allow for posthumous and expedited grants.'

The petition's description says: "Amend the Gender Recognition Act (2004) so that:

  • "The family of a dead trans person with no GRC can apply for a GRC and reissued death certificate via statutory declaration.
  • "Where a trans individual has been diagnosed with a terminal illness, they can acquire a GRC via statutory declaration."

It also says: "One of the primary functions of a GRC is to do with dignity in death.

"Where a trans individual of any age dies unexpectedly, or is diagnosed with a terminal illness and does not have the time to go through the process, a source of trauma for them and/or their family/friends may be that their death certificate will be [issued] in the wrong gender."

The petition concludes: "Allowing for a process based on statutory declaration in these extenuating circumstances is a small step towards rectifying the indignity of this scenario."

At the time of writing, the petition has garnered more than 1,500 signatures, across almost every Parliamentary constituency in the country.

Cheshire Constabulary has reminded individuals to avoid speculating about the circumstances of Brianna's death, as this could prejudice any trial that may take place.
