AN unlicensed driver who was caught behind the wheel while on drugs on one of the town’s busiest roads told magistrates ‘that’s f***ing b****cks’ as he was jailed.

Acer O’Toole, from Orford, was locked up at Warrington Magistrates Court on Thursday, June 9.

Magistrates heard that police stopped a Mitsubishi car being driven by the defendant shortly before 8pm on April this year on Knutsford Road in Grappenhall, believing the vehicle to be stolen.

The 35-year-old ‘appeared to be under the influence’ and failed a roadside breathalyser test, while a drugs wipe showed that he had cocaine and cannabis in his system.

He only had a provisional licence and was also uninsured.

O’Toole, of Greenwood Crescent, failed to provide samples for analysis after being arrested and taken into custody as he ‘said he couldn’t cope with his mental health’ – appearing ‘agitated’ during the procedure.

The court was told that he has 38 previous convictions for 74 offences, dating back to 2000.

He admitted driving without a licence, driving without insurance and failing to provide a specimen for analysis during earlier hearing and was handed 12 weeks behind bars.

Sentencing, magistrates panel chairman Alfred Bean said: “This is a serious matter.

“Not only did you fail to provide a specimen for analysis, we find it was a deliberate refusal.

“You had a high level of impairment on the screening device, and you also had cannabis and cocaine in your system. You have an unenviable criminal record.

“We accept there’s not a previous conviction for failing to provide a specimen for analysis, but there are a number of driving offences there. We don’t believe there is a chance of rehabilitation.

“The custody threshold has been passed.

“You are going to be sentenced to a term of imprisonment, and it is not going to be suspended.”

O’Toole reacted by saying: “B****cks – that’s f***ing b****cks.”

Mr Bean responded by saying: “If you carry on this way you will be getting done for contempt of court and getting more weeks – stop now.

“You’re making this quite difficult.”

O’Toole will be banned from driving for four years upon his release from prison, and was also told to pay court costs plus a victim surcharge.
