AN ‘actual monster’ who told a child he would ‘shoot her’ if she screamed while raping her has been jailed.

Matthew Philbin, of Hurst Lane, Glazebury, orally raped the 14-year-old daughter of a woman he had been on a date with.

Philbin appeared before Liverpool Crown Court today, Thursday, after pleading guilty to rape at an earlier hearing.

Prosecuting, Lee Bonner told the court how the horrific offence happened in the victim’s own bedroom after Philbin was invited into their family home.

Philbin had been making an unusual number of trips to the toilet, which he later told the probation service he was ‘nosing’ around for ‘no plausible reason’.

The victim woke up at 4am to see Philbin at the end of her bed who began ‘crawling’ to her.

She described him as looking like ‘an actual monster’ climbing across the bed.

The court heard how he pulled her trousers and underwear down aggressively and the victim responded by screaming for her mum and kicking him.

Mr Bonner stated that the victim was putting up a fight but Philbin hit her across the head and put his hand over her mouth to muffle her screams and also swore at her.

He then exposed himself before asking her for oral sex.

The victim told him ‘no’ a number of times before he then backed her into a corner and said: “If you scream I am going to shoot you.”

He then dragged her onto the bed and forced her.

This took place for three minutes until they were disturbed by the victim’s mother who had come to check where Philbin was.

Philbin tried to convince the victim to tell her mum that she had had a bad dream.

Mr Bonner said the victim became ‘hysterical’ and told her mum she had been raped.

Philbin was then kicked out the house and locked in the back garden.

When officers arrived, they found Philbin hiding in the back garden in just shorts and socks and a later search found viagra tablets in his overnight bag.

Mr Bonner told the court that the defendant initially denied all sexual elements and said he had gone into her room after she had a bad dream and ‘tripped’ and landed on top of her.

Forensic examinations revealed matches for the victim’s DNA on Philbin’s underwear.

The victim told officers in an interview that she was scared he was going to kill her family.

Medical examinations also revealed the victim had various facial cuts and bruises which were consistent with her account of being slapped and the defendant being forceful towards her.

Defending, Simeon Evans stated that Philbin has ‘shown a genuine expression of remorse’.

He said: “It is right to say he was acting entirely out of character when he behaved in the shocking way that he did.”

Mr Evans also told the court that his client does not ‘accept’ or ‘recall’ telling probation he was ‘nosing around’.

Concluding, Judge Stuart Driver QC said: “On the night of the offence, you were a predatory, violent, determined rapist of a child.

“I am unconvinced your expression of remorse is genuine.

“An extended custodial sentence is necessary to prevent the public from risk of serious harm.”

Philbin was handed a 13-year prison sentence which he will serve at least two thirds of before being referred to the parole board.

He will serve the remaining five years on licence.

He was also handed an indefinite restraining order and indefinite sexual harm prevention order.
