A PRISONER who was serving a sentence for sexually assaulting a teenage girl as she walked home has been jailed again for raping an inmate in his cell.
Ramijah Hindes told the inmate he was sharing a cell with at HMP Risley that he wanted him to ‘feel how his victims felt’ before telling him to take down his trousers and raping him.
Prosecuting at Liverpool Crown Court on Monday, Simon Christie said that both Hindes and the victim had been moved to HMP Risley from another prison and were put into a ‘vulnerable prison wing’ due to the nature of the offences they had been jailed for committing.
The 23-year-old defendant, of no fixed abode, had vocalised to prison officers how unhappy he was to be put in a cell with that particular inmate.
“He did not think it was a good look to be put in a cell with the complainant because of what he was jailed for.”
That same evening, it was heard how Hindes told the complainant to pull down his trousers and proceeded to rape him.
It was only when the defendant left the cell the next morning that the victim then told a prison officer that he had been raped.
Hindes was arrested and taken in for a police interview where he denied the allegations, however after forensic samples had been taken and there was evidence of cells from the defendant found on the victim, he changed his story to state that the pair had ‘consensual sex’ that evening.
Count two of rape on the indictment was set to go to trial after Hindes pleaded not guilty. However, on the morning of the day the trial was set to go ahead, he changed his plea to guilty.
Three victim impact statements from the victim were read out to the court in which he stated how the effects and impact of the incident on him had been ‘immeasurable’.
“He has had sleepless nights. He continues to feel on edge and panics that it will happen again.”
The victim had to be given preventative treatment for HIV which made him ill for a period time.
Mr Christie went on to detail the defendant’s extensive record of previous offending, most when he was a juvenile and some more recent offences.
The most recent offence dated back to March 2022 which was the offence he had been serving a jail sentence for when the current incident occurred.
Hindes had been serving a 45-month sentence for sexually assaulting a 17-year-old girl as she returned home from a chip shop in Liverpool.
The defendant followed the teenager and grabbed her, pushing her onto the floor before sexually assaulting her.
She screamed and managed to break free from him. It was following a police appeal that Hindes handed himself into police and was convicted for the offence.
Defending, Phil Tully said that his client accepts that only an immediate custodial sentence will be given.
“This is not a case where Hindes engineered a situation where he was alone with the complainant.
“He accepts this would have been a very unsettling and frightening incident for the complainant.
“He has shown remorse and insight into the effects this would have had on the victim.”
The defence barrister added that Hindes had experienced a ‘very difficult childhood’ where he had experienced physical and sexual abuse.
Before passing sentence on the offence, Honour Judge Katherine Pierpoint addressed the defendant, who was on video link from prison.
“On that afternoon you and the complainant were moved to HMP Risley. You were both placed on a vulnerable prison wing. You told the police you did not want him to be in the cell with you.
“You are physically bigger than the complainant. You told him that you wanted him to feel how his victims felt.
“You told him to take his trousers down.
“The next morning, he reported it to staff, and you were arrested the following day. In the interview you denied any contact with the victim.
“Your semen was detected from swabs. You then changed your account to having consensual sex. The morning of the trial you pleaded guilty to count two of the indictment.
“You focused that evening on your own satisfaction When the opportunity presented itself you took advantage of this position.
“And despite the fact you carried out sexual offending treatment, you still went on to offend in a sexual way that evening.”
Judge Pierpoint handed the defendant a custodial sentence of six years and three months with an extended licence period of five years.
A restraining order against the defendant coming into contact with the victim was issued for the rest of his life, and he will be signed onto the sex offenders register for life.
