A MAN who used ‘the most foul and abusive language’ before headbutting police outside a Morrisons in Birchwood has been spared jail.

Jake Saxon, of Castle Street in Stockport, appeared in Liverpool Crown Court on Monday afternoon.

On November 5, police officers were called to Admirals Road after receiving reports of a domestic incident, in which officers were called out of concern for Saxon’s welfare.

When the officers arrived, however, the 29-year-old was no longer there and had gone to the nearby Morrisons.

The incident, which was captured by police body camera footage, showed the officers approach Saxon and proceed to arrest him inside the shop on suspicion of criminal damage.

Prosecution for the case, Ian Criddle, told the court that after being approached by the officers, Saxon began using ‘the most foul and abusive language’.

In the footage, which was shown in court, Saxon could be heard telling police ‘your breath stinks’ and ‘I’ll f*****g bite you in a minute’.

The court heard that Saxon also told one of the officers ‘I bet you were raped as a child’.

The officers, who had restrained Saxon on the floor, then removed him from the shop as a crowd gathered and children were present.

It was while outside that Saxon continued to hurl abuse at the two attending officers, calling them ‘g*mps’ and ‘muppets’ before proceeding to headbutt one of them.

The court heard that the injured officer immediately began to bleed from his nose and feel dizzy, but no medical evidence was shown in court to confirm it was broken.

Homophobic language was also used towards both officers, calling one a ‘f****t’ and the other an ‘ugly looking lesbian’.

A search was carried out on Saxon, who was found to be in possession of a small amount of cannabis and he was taken to hospital as he had said he had taken an overdose.

While at the hospital, the 29-year-old continued shouting and swearing and was eventually removed and placed in a police van, inside which he spat on the walls and kicked the van cell door, damaging it in the process.

A victim impact statement was read to the court on behalf of the injured officer, who said that the incident has had a ‘lasting impact’ on his life.

“The incident is constantly in my head,” the statement read.

“I considered if this was the job for me. I don’t go to work to be assaulted.

“I think about it regularly and I believe I will for the foreseeable future.”

Saxon pleaded guilty to the six offences on May 13 at Warrington Magistrates’ Court and offered an apology in his initial interview.

Defending, Mr Christie told the court that at the time of the incident Saxon had been struggling with his mental health and has self-referred himself to seek help with drugs and alcohol.

While passing sentence, Mr Recorder Killeen referred to the language used by Saxon as ‘disgraceful, violent, abusive, thuggish conduct’.

Saxon, who has no previous convictions, was sentenced to 12 months imprisonment for assaulting a police officer and two months imprisonment for both charges of threatening behaviour and insulting words, which will run concurrently and have been suspended for two years.

The 29-year-old saw no separate penalty for criminal damage or resisting arrest, but must complete 180 hours of unpaid work, attend a drug rehabilitation requirement for six months and attend 15 rehabilitation activity days.

Compensation of £750 was also awarded to the injured police officer and the cannabis found on Saxon was forfeited and destroyed.
