A MAN threatened to kill a former work colleague acquitted of being a paedophile in a Facebook live video.

Duane Henshaw, of Archer Avenue in Latchford, was visibly upset throughout the sentencing at Warrington Magistrates' Court on Wednesday.

The court was told how he made the video in a ‘drunken rant’.

The incident happened at around 11pm on March 11, with a member of the public bringing the video to the attention of Cheshire Police.

In a statement read out by Debbie Byrne, prosecuting, police visited the 33-year-old’s home after being alerted of the contents.

The defendant told police he had been drinking in Warrington all day and had seen someone in a pub who he used to work with and had recently been acquitted in court of being a paedophile.

The court heard Henshaw said he did not speak to the man, however the man looked over to him and ‘smirked’, giving the impression that he had ‘got away with his crime’.

When arriving home from the pub, Henshaw said he was ‘nine out of 10 on a scale of drunkenness’ and filmed the video in his back garden to ‘appear clever but it backfired’.

Screenshots were taken of the defendant making the threats in the video while holding a large knife which he said was made in a ‘drunken rant’.

He also added that he had no intention of carrying out the threats made in the video and pleaded guilty at the first opportunity.

The court heard that Henshaw was struggling with alcohol misuse and is currently serving a two-year community order for drunkenly pushing his partner last year.

Gary Heaven, defending, stated that due to Henshaw’s issues, a custodial sentence was ‘not appropriate’.

He continued: “The knife was present but was not taken onto the street, and had it not been broadcast, there would have been no offence at all.

“Nobody was at risk and the video was limited to his Facebook contacts.

“Henshaw fully cooperated with police and pleaded guilty at first possible opportunity.”

When sentencing, chair magistrate Lynn Colter-Howard said: “We have taken a long time to discuss this matter and it appears you have gotten yourself into a bit of a mess.

“You need to get your finger out, get yourself sorted and do not let us see you in court again.”

Henshaw was handed an eight-week sentence suspended for 12 months and ordered to do what is asked by the probation service.

He was also made to pay £400 in court costs and must complete 30 rehabilitation activity requirement days.
