NOTICE OF CONFIRMATION OF MODIFICATION ORDER - SECTION 53 OF THE WILDLIFE AND COUNTRYSIDE ACT 1981 - The Cheshire East Borough Council Definitive Map and Statement (Addition of Restricted Byway No.'s 28 & 29, Parish of Middlewich) Modification Order 2020
On the 18 March 2021 the Cheshire East Borough Council confirmed the above named order. The effect of the order, as confirmed without modification, is to modify the definitive map and statement for the area by adding:
Restricted Byway No.28 Middlewich commencing at its junction with Nantwich Road (A530) at O.S. grid reference SJ 6971 6574, along a track known as Manor Drive, and running in a generally southerly direction for approximately 88 metres to O.S. grid reference 6970 6565 at its junction with Restricted Byway no.29 then continuing in a generally south south westerly direction for approximately 52 metres to O.S. grid reference SJ 6968 6561 and its junction with Kerridge Close (UY1972).
Restricted Byway No.29 Middlewich commencing at its junction with Restricted Byway No.28 (Manor DriveJ at O.S. grid reference 6970 6565 and running in a generally easterly direction for approximately 52 metres to O.S. grid reference SJ 6975 6565 and its junction with Buckley Close (UY2149), A copy of the Confirmed Order and Map has been deposited and may be seen free of charge during normal office hours in the Rights of Way Unit at the office of the undersigned, and at the offices of Cheshire East Borough Council, Westfields, Middlewich Road, Sandbach CW11 1 HZ. Copies of the confirmed Order and the Map may be obtained free of charge from the undersigned.
The Order became operative as from the 18 March 2021, but if a person aggrieved by the Order desires to question the validity of the Order on the ground that it is not within the powers of Section 53 of the Wildlife and Countryside Act 1981, or that any of the requirements of Schedule 15 of the Act have not been complied with in relation to it, he or she may, within 42 days from the 1 April 2021 make an application to the High Court under paragraph 12 of the said Schedule 15.
