A BENEFIT cheat who falsely claimed more than £6,000 has been ordered to pay the money back and handed a 120 hour community punishment order.

Lee Gemmell, of Vulcan Close, Padgate, appeared at Liverpool Crown Court on Thursday after failing to notify the council he was living with his partner on Harbord Street.

The 34-year-old was overpaid a total of £6,544 made up of £2,676 of income support, £2,995 of housing benefit and £873 of council tax benefit.

He was also ordered to pay £500 costs to the court.

Adrian Webster, the council’s benefits manager, said: “Deliberately withholding information that affects your claim is stealing. All benefit theft is crime and the council is determined to bring fraudsters to justice.”

Anyone who suspects benefits are being claimed fraudulently should call the council's confidential benefit fraud hotline on 442282 / 442283 or e-mail fraudteam@warrington.gov.uk.

Yeh, where will he get this money from to pay it back?

Stupidity of the system is as much to blame.

And the girlfriend he lives with, I assume she is in benefits too?

And while he's doing his community work hr can't be seeking employment which means he will not be able to claim job seekers. So what will he resort to to survive. I better punishment would be an enforced employment with a low salary say £100 a week for two years, at the end he would be accustomed to a working lug , gained skills and be employable.

The system is broke, it's too easy to blame the people in the bottom of the ladder for doing what they can to get by.

richiepooh its small minded people such as yourself which is why this countries on its a**e. as the story makes out it was me a working gilfriend apparently living with lee which is why he was over paid a certain benefit. so before you make assumption get your facts correct!! and for anybody else wanting to have a nosey an stick there 2p in. lee was advised to pleed guilty in this case to save his current employment role. he was never made guilty and in all aspect was due the benefits he previously clamied! dont believe everything you read and keep your curtain twitching opinions to yourself!!

Sorry my mistake, I was defending a person down on thier luck in a system that forces the poorest people in society to have to be dishonest in order to survive, stupid assumption, clearly it was a working couple screwing the system with real fraudulent activities just because they can. Obviously the worst lowlife of society that sappl the resources of the Welfare state which is why the country is on its knees and why the limited pot that the state has to offer genuine claimants and pensioners is so little. I assume you enjoyed spending the stolen money from us honest tax payers too on your curtains.

Well said richiepoo ! He was told to plead guilty as an act of self preservation, this does not make him honest ! Either way you look at it he is a thief , cheat, selfish and not trust worthy . The repayment should be doubled if the cheat is working or at least have interest on !

I know she makes out that he only plead guilty to keep his job!! Hello nucklehead, he plead guilty to reduce his punishment. £6000 that's long term fraud too not just a couple of weeks oversight.

ladies please... as comical as it is to read you putting the world to rights. and the massive satisfaction you must be getting out of having your say let me just clear a few things up for you.

use the word fraud again and il do you for slander! no where in this article does it say fraud and the charge was ADMIN ACT. lee claimed these benefits at the start of 2011 when he left work to look after his child full time. he stopped claiming when he moved into my home a year later. so no we wouldnt still be at it as you say if we hadnt been caught!

as a couple we did what most did and i stayed at his a few nights a week at the time i was under the impression this was allowed up to 3 nights a week (take note people this is not) it seems there is a massive grey area on whats right from wrong when having some one stay over. lee never advised the council he was in a relationship and his girlfriend stayed over at the weekend or maybe through the week. lee never benefited from my wage and i didnt contribute to his house hold bills.


In all benefit cases its the amount in question that determines the consequence. so NO pleeding guilty did not get lee a lesser outcome in anyway!

I understand you must have a massive interest in the peoples money and looking after our tax payers so i find it abit hard to believe my dear old richie pooh that in your 1st comment you would condon such an act of dishonesty as you thought we were both on beneifts, so thats ok is it? as long as you on the system you may aswel screw it why your there?

not all these cases are black and white and i fully appreciate such a massive head line will attrack the attention of people. lee admitted to not informing the council which is why he took his punishment and will pay back the money and do the unpaid work ahead of him. it was an act of the unknown not of dishonesty, theft, cheating or trust! which again is alittle pot ketle black coming from a bunch of people who wont use there full name when making such acusations.

it was advised to lee to use this as a learning curve and i hope everybody else does the same if your going to claim benefits make sure your aware of the rules around people staying at your house, like lee you to could be made an example of and find yourself in a similar situation.

ok benefit fraud may be wrong but the MPs are all doing it on a massive scale and all these corporate bosses hardly pay enough tax .
also before the keyboard warriors starting picking on people look at the bigger picture , hamza and all these unwelcome asylum seekers screwing us for millions .

Please listen to Nikki Gemmell.I've known a single mum who has had to pay back benefits, because her abusive ex,who is the father of her children, stayed overnight twice a week on contact visits. He never contributed to household bills nor towards the needs of his children, as he was also unemployed. This depressed, low self-esteemed single mum had then to seek employment as a carer, in the local nursing home & pay for childcare while she worked. There was little left of her earnings for day-to-day living.
