Thelwall New Road man jailed at Warrington Crown Court

Warrington Crown Court Warrington Crown Court

A MAN arrested five minutes after he decided to try and deal cocaine to friends in town centre bars has been jailed for two and a half years.

Andrew Potter, of Thelwall New Road, was collared by police on Bridge Street carrying a small amount of the class A drug on November 12 last year.

Warrington Crown Court heard on Monday how the 28-year-old had bought ‘more drugs than he normally would buy’ after a gambling windfall.

Prosecuting, Martin McRobb said the cocaine user intended to sell some to friends while drinking in the town centre before he was randomly stopped by police.

The defendant, described as a ‘low level offender’ by Judge Nicholas Woodward, has no previous convictions for drug offences.

Defending, Simon Berkson said his involvement in dealing was ‘extremely short lived’ and lasted around five to six minutes.

The Mere Golf Club employee pleaded guilty to possession of a class A drug with intent.

Lol what a tool, it was wrong what he did but his solicitor must've been a really bad one if the CPS managed to get him with intent when the storie even says it was for a small amount when people who drug deal instead of getting a job always manage to get off because the Police and CPS can't prove intent even when they're caught with a substancial amount of drugs if he's never been in trouble for anything in his life i do think that 2 and a half years is a bit extreme and a waste of tax payers money when every day Warrington judges allow violent offenders to remain free with a few hours of CS. Really not the best way to spend tax payers money and even though it's totally illegal what he did he needs to get a proper solicitor and appeal, should've got 12 months max cause even though i don't have anything to do with illegal drugs myself even i know never admit intent unless you've spoken to a solicitor and the Police have a lot of evidence which they don't if he was randomly stopped.

It just doesn't make sense at all when judges are allowing violent offenders with a lot of previous violent offences to walk free every day

Virtually every problem I observed whilst in the living hell I called Warrington came down to drugs. The problem has to be addressed, and not considered minor.

I agree alcohol is the most commonly used drug that turns people into violent psychopaths but what's that got to do with cocaine? Not one person has said this was a "minor" offence so feel free to comment on why you said we did at what's it got to do with alcohol being the most socially damaging drug know to man? It costs over £40k per year to house 1 prisoner and i as a tax payer would rather have a violent repeat offender behind bars than some kid who had a win at the bookies and was stupid enough to buy a small amount of drugs with it, plus unlike most drug dealers he had a job and had never been in trouble with this ever. 30 months for a first time offender who'll lose his job over it when judges wid sentence offenders who've snapped someones jaw or put a glass in someones face because they "looked at them funny" or "they were chattin to his partner" very seldom get jailed and more often than not just get community service. If the sentences that can be given to violent offenders, sexual predators and paedophile's were all given out then this wouldn't be anything what anyone would comment on but the excessive sentence given to this non-violent first time offender is ridiculous and a total waste of tax payers money. He'll meet criminals in jail who he's never had anything to do with in the past and may stay in touch with the career criminals and when he get's out he won't be a tax paying member of society anymore and is more likely to get into higher level crime because of it and maybe turned into a violent criminal himself. So all in all it's going to cost up £100,000 before time off for good behaviour but if he is let out on licence after serving just over half him sentence probation isn't cheap either and he'll be forced to claim benefits from the state because it's hard enough for people who're 100% fit with no criminal record to find a job and even places like the Asda perform CRB checks. After all that do you still think prison is the best place for a first time offender that's got a job and is a tax payer who was caught with a small amount of drugs is the best place for him or do you think a community punishment so he could keep his job and remain as a tax payer but have the custodial time suspended for say 3 years? I do anyway it doesn't make sense jailing him when there's much worse violent criminals having their custodial sentence suspended.

Totally agree with this!
I have never taken drugs, and have zero tolerance for those who take/deal them,BUT...someone I know was jailed for 2yrs 8months for a first offence of possession with intent to supply(cocaine)...by the same judge,YES,THAT'S YOU JUDGE DAVID HALE...who last week let a self confessed child molester walk free because the offence took place 15 yrs ago+he hadn't done anything similar since ffs!!!
How this judge knew that is anyone's guess, but I know what I consider to be the more serious offence...
I think some of these judges need a serious reality AND morality check...

The court hears the evidence, we see a quote from the defence on here. It could be that not every word of it is true. Stopped the first time he ever had a few more drugs than normal - and he got the money to buy them from a win on the horses? Is the word gullible in the dictionary?

Thank you scouse that's totally my point but like usual when someone makes out something you didn't say and doing so make himself or herself look like a total blert they never reply. Had to add that about alcohol being the most expensive to deal with by Police and NHS along with being the most physically harming as well as socially harming. I love it when people believe the hype by the Government about how dangerous illegal drugs are because the majority prob barring crack and crystal meth don't do even half the damage and cost the state as much as alcohol does. I'm much rather see a first time offender with a small amount serve a community service and keep his job and keep paying tax into the UK not costing 40k per year, socialising with career criminals bad turning from an average lad to a career criminal. It's the violent repeat criminals, they sexually violent criminals and paedophile's both male and female who should be locked up and be on drugs for life that suppress their sexual urges with couldn't be that had to do. When i was really ill in 2000-2011 i was on some heavy duty drugs and there was 1 called Fentanyl, it is a controlled drug but it nearly ended my relationship cause i had no sexual urge to my girlfriend. Didn't have a sexual urge for anyone to be honest lol i know it's controversial but what wrong with given convicted sex offenders it to combat crimes before they happen? It is an opiate but the only effects it has it's knocks your pain right down and exactly the same as your sex drive.
I wouldn't mind paying £30 per week to keep a beast away for our children. Also unlike other strong opiates that produce a soft euphoria experience Fentanyl does not. It's an extremely good pain killer (one of the best known to man around 100x as potent as morphine) the side effect profile is drowsyness an constipation plus because of how it works if the paedophile was a heroin abuser he'd need a ridiculous amount of heroin to knock the Fentanyl from his opiate receptors. Although there would be controvery involved it's doesn't go as far as cutting their bits off which in my opinion is the best course of action cause once a paedo always a paedo so if any parole board is silly enough to think that they're no danger to society and the parolee say's they no longer pose a problem to children they shouldn't have a problem of accepting a Fentanyl implant which they can't remove themselves. In the long run our children will be a lot safer and they'll be space for violent, repeat career criminals which will save thousands in the future of possible victims of these criminals and Judges won't sentence based on how full our prisons are and parole boards won't be releasing people that're still a danger to society because there cell is needed by another prisoner that's just been sentenced and waiting in a sweat box. Certain drugs like crystal meth and crack cocaine should never be given leanincy but the other group of drugs although damaging are not close to what alcohol has been doing for years and although they're still illegal and wrong which is how they should stay because they do encourage criminal behaviour the nations Judges need to work towards the same sentencing guidelines. If i just read what he had been given for being in possession of a small amount of drugs automatically i'd think there was insinuating circumstances like a high speed car chase that had resulted in serious injury of dead. Not long a go a failed asylum seeker who was already banned hit a little girl and killed her leaving her under the car while he ran off! He was caught in the end and charged. Multiple times he was on bail he was caught again driving while banned and in the end only got 10 months incarceration! When he got out even though he'd exhausted all his appeals a human rights court judge should he be deported it'd breach his human rights. The little girls father has seen the Iraqi in town numerous times and asked the court what about his daughters human rights. As usual they said they don't discuss individual cases, although it off topic it's about the Britain retained controls of our own borders and how we run our social security system because non UK born people are costing the UK billion in healthcare, Legal aid, schooling, benefit payments, housing and that's to name a few. This is our country that our ancestors have spilt their blood for and if they could see us now they'd think why do we do that? England isn't England anymore we're the laughing stock of the othe EU countries and the rest of the world by doing all the ridiculous demands the EU makes of us unlike France who've rejected certain parts of the human rights act so French citizans are placed first which how it should be in every country. Of course the EU took on action against France cause as much bark Brussels have they've got no bite. Just because we look after our people on hard time's better than any other country in the EU and worldwide is not an invite for specially Polish and Asian families to come to the UK claim benefits and then bring multiple family members all expecting to be supported by the state and can't work because they can't speak English and if the DWP enrol them on to an English course they're straight on the phone to tax payer paid human right solicitors! How do they know all the loop holes and how to drag out an asylum claim for as long as they can in the first place?

So it begins in Latchford which i thought that's why i said "i think" hence i wasn't 100% sure. If it defo started in Latchford that would be worthy of your shirty comment. So you've made yourself look a bit of a mong really just cause you couldn't think of anything better to say :-)

Honestly wish i could but we all know the Judges are private schooled individuals who're totally out of reality cause all the see each day are the worst of society and when they see someone who's first offence it is and has obviously been tricked by the Police to make a statement they automatically put them in the same bracket of everyone else who's admitted or proved intent. Anyone who's crime is violence related they also place them in the same bracket as the other violent offenders whether they're career criminals or not they get community punishment unless they're already on tag which is more common than we think. I actually tried to join a party to run for Government but came up just as expected, if you've not been privately schooled you've gotta have a few thousand pound to join plus all your own election funds. By doing this the Government parties keep real in touch people out of the house of commons that would've raised the ridiculous petty cash the MPs were claiming over their £65k a year because they thought they were underpaid even though they get more holidays than everyone else and prob school children! Plus their homes in London plus others they flip as their main home and sell to swerve capital gains taxis and even houses with full paid mortgages that they're claiming rent on and the ultimate one was a male mp submitting a claim for Tampax! They'll never allow the public to be a crown court judge and it's unlikely to be a magistrate. The only time people get into court is Jury service and i as 1 don't know anyone who's been called up for jury service which i'd love to do but don't think it'll happen

Just for clarity. Thelwall New Road is not in Latchford. It starts on the Grappenhall side of the swing bridge at the junction with Knutsford Road and like Emma says goes to Thelwall.
Think you may be getting confused with Thelwall Lane which is in Latchford but does not go to Thelwall any more (since the ship canal was built I assume).

Thank you for correcting me, fair enough i did think it was the road that runs upto Alcan (that's if it's still there by the docks) but my second choice was the correct one, don't know the exact place where Latchford begins cause know it's not as straight forward as the other side of the canal because with Stockton Heath according to the sign post begins after Fairfield Road. Don't know whether Latchford is the same but i did now be is Thelwall Lane or Thelwall New Road neither had the majority in Thelwall so somebody getting their thumb stuck or the caps key after looking at other website's before commenting maybe or purposely pressing caps lock to type THELWALL just because it has that in the name of the road wasn't the smartest choice. That's like writing that the A49 through Stockton Heath is really LONDON because it's called London Road at some point.
