7:26pm

But that is a question for another day.

For now, residents will celebrate their victory.

But with this decision likely to face an appeal, and an appeal against a 12 year extension being rejected due next month, the Arpley saga looks set to rumble on.

Thanks for joining us.

7:24pm

So it's all over. For now.

In truth, the arguments against landfill continuing were familiar and the council was quick to agree with residents.

The real question is when will dumping end at Arpley.

The council has already withdrawn an enforcement notice because it cannot afford legal costs.

Remember, landfill was due to end in October last year.

7:22pm

The five year licence extension is rejected unanimously to a chorus of cheers and applause.

7:20pm

APPLICATION REJECTED

7:20pm

7:18pm Thu 23 Jan 14

Star1307 says

When it gets rejected surely this will mean they have to stop dumping rubbish near our homes. Why do they get 6 months to appeal? During the 6 months they will still dump rubbish. I thought they were dumping illegally since nov/dec 2013.

7:19pm

Growing anger among councillors for 3C's failure to show. Clr Lawrence Murphy says it shows 'disdain'.

Clr Bob Barr says he is 'disgusted' and 'appalled'.

Every member of the committee has spoken against the developers.

7:17pm

Clr Geoff Settle says a failure by the applicant to turn up to speak, and answer questions, shows 'contempt' for council and residents.

7:14pm

The application is now being discussed by the planning committee. Councillors also say they are against it.

7:13pm

Seems to be strong feeling in room that application is a delaying tactic so landfill can continue.

7:11pm

A warning for everyone against the application.

Planning officers reveal developers have six months to appeal if licence extension is rejected.

7:10pm

Olivia, a young girl who lives next to Arpley, says she is woken by wagons passing her house, and says flooding is caused by rubbish blocking drains.

7:08pm

Clr Wright finishes by mentioning Warrington Guardian story and agrees that it's time to 'lock up and throw away the key'.

7:07pm

I find it incredible we are here today to consider another planning application for Arpley. We will fight to the bitter end to get landfill closed once and for all.

7:00pm

There will be no one from 3C speaking in favour of the application. Clr Pat Wright says this shows lack of consideration from company.

6:58pm

Mr Norris finishes by saying further landfill is 'unacceptable legacy' for town's children.

Gets standing ovation from some.

6:57pm

Speaks of 'intimidating wagons with stinking loads'.

6:55pm

People are queuing up to have a go at developers here.

A lot of anger, unsurprising given the history of the site, and long battle for residents for landfill at Arpley to end.

Neighbour Steve Norris is up next.

6:52pm

Warrington South MP David Mowat is also against the licence extension and says matter has been raised in parliament.

6:50pm

Cheers for Mr Harvey, a neighbour to Arpley, after that comment.

6:49pm

It's an awful continuing nuisance that has gone on long enough.

Mr Harvey on the landfill site

6:46pm

Mr Harvey is also speaking against.

He criticised the treatment of residents by developers, saying they have shown total  disregard.

6:43pm

Goes down well. Solid round of applause.

6:42pm

Derek Moody is first up to speak against the application. Says 5 year extension is not needed and appeals are based on delaying process so dumping can continue.

6:38pm

We're getting under way at the Parr Hall. Lots of residents in attendance

6:26pm

For anyone who can't make it but still wants to get involved, join the debate on Twitter using #Arpley.

6:22pm

There are already some residents waiting in the entrance of the Pyramid's foyer, eager to get going.

Seats will be taken shortly, I'm told.

It is due to kick off at 6.30pm at the Parr Hall.

All are welcome to attend.

The conditions upon which WBC gave approval for 3C Waste to tip at Arpley for the original period specified in their application could have been drawn up with sufficient legal force as to prevent challenge. Why weren't they? Why did WBC over the period of tipping to date fail to monitor 3C Waste's performance at Arpley and fail to anticipate 3 C Waste's reluctance to meet the terms of its original application and its intention to carry on tipping?

But if WBC can't afford legal action, what stops the tipping? A meeting won't.

Surely if the legal argument is sound, WBC would get awarded costs?

If it really is illegal, meaning the tipping company 3C could be held liable in law for apparently flouting the terms of the Council's approval and consent, 3C would have stopped by now. But it is clear from 3C's behaviour in continuing to tip and the Council's climb down in withdrawing its notice to stop tipping served on 3C sometime late in 2013, the Council's paperwork is not and never has been up to scratch, despite what we might hear. Councillors can symbolically wring their hands while publically saying they are 'disgusted' and 'appalled', that it’s time 'lock up and throw away the key' or that by its actions 3C shows 'contempt' and ‘disdain’ for council and residents as much as they like, but this does not detract from the weakness of the Council’s position. This is not the first time Warrington residents have suffered from the continuation of tipping beyond what the Council had led them to believe. One of those previously affected residents recently wrote of his sympathy with those affected by Arpley in a letter to the WG.

I had all intentions of attending this meeting but I was unable to due to an operation the day before. I am a resident on Saxon Park each morning I leave for work just before 7am, I am met by trucks at the end of the estate that have no concern for anybody but them self's, they come round the corner at the end of the road without stopping to check if its clear they just expect you to get out of there way. I have been forced to mount the curb on several occasions which as resulted in damage to my wheels. When I bought this house I made inquires to the landfill on the situation to the life term and was told it had just under 3 years to the end of its term then it would be landscaped, I bought my house on the basis of this information. Each summer I am unable to sit in the garden due to the mass invasion of fly's and blue bottles. I am also forced to sit inside or close my windows due to the vile smells that blow across and have arranged bbq's that I have abandon also due to this stench. I am constantly finding rubbish in the roads that have fallen from the trucks carrying this waist mostly from other surrounding authorities that are using Warrington as its dumping ground, They are happy to dump it here away from there own back gardens that is why these authorities are happy to support 3C's application. All I want is to have a fresh air without the vile smell & the vermin of the blue bottles in my house is this to much to ask.
