A 60 day notice calling on Arpley tip bosses to stop flouting the law and dumping rubbish after their licence had expired has been withdrawn.


Warrington Borough Council had first handed out the notice to FCC Environment in October after officers found that landfill waste was still being imported to the Sankey Bridges tip.


But the move to withdraw the notice has angered residents.


John Mulhall, who will be speaking on behalf of residents in the upcoming planning inquiry into FCC Environment’s application to continue to use the site, said: “Why did they issue it in the first place. It is giving false hope to the community.”


A council spokesman said: “The council’s decision to withdraw the breach of condition notice was based on legal advice.


“The council will continue to defend the ongoing appeal and will review the enforcement position when we hear the appeal decision. In the meantime the council will continue to discuss with the operator matters including the appropriate restoration of the site.”
