Man jailed for attempting to rape woman on her birthday

A MAN has been jailed for attempting to rape a woman on her birthday.
David Young, aged 45, of Cabul Close, attacked the victim on her 26th birthday after spending the night celebrating with her.
At Warrington Crown Court on Tuesday, Judge David Hale sentenced him to 40 months in prison.
He said: “David Young, on this night after 45 blameless years, you have too much to drink and circumstances conspire that you end up in a flat with a girl who has also been enjoying a drink.
“She gets tired and goes to bed expecting you to leave.
“You decided you would try and have sex with her.
“You knew she had not agreed to it.
“She went mad at you, threw a glass at you and you put your clothes on and scurried off into the street.
“I accept this was wholly out of character and it was almost certainly drink that removed your inhibitions and good sense.
“The problem is it has seriously upset her as any sexual attack would.
“She has self-harmed since.
“She can’t just sweep it under the carpet.
“There is a real victim suffering real consequences and that is why you must go to prison.”
The court heard how Young and the woman were drinking in the Howley pub, Parr Street, in October last year.
They went back to the victim’s flat, and after she fell asleep, Young forced himself on her.
She woke, throwing a wine glass at him, and making a ‘hysterical’ call to police.
In a statement she said she is now unable to have a physical relationship.
Young, who has long term hearing problems and wore hearing aids in court, was arrested and initally denied the attack.
A week before his trial was due to start on July 15, he pleaded guilty to attempted rape.
Jeremy Rawson, defending, said the case was ‘exceptional’ and called for the prison sentence to be suspended.
He said: “The defendant is remorseful and has been devastated by what took place.
“This was an appalling incident that he accepts has caused damage and has reverberated for his family as well.”
