Pervert sent to prison after sex with girl, 13

A PERVERT tricked into a relationship with a schoolgirl who faked her age, continued to have sex with her despite discovering she was under 16.

Nicholas McGibbon, 22, twice had sex with the 13-year-old girl, who cannot be named, after she said she was 15 and not 16 like he had been led to believe.

Sentencing McGibbon to nine months in prison, the recorder Mr Keith Bush told him: "The serious thing is that you knew perfectly well that this girl was under 16 when you had sex with her on both occasions.

"It is not a case of getting carried away - what you did, you did knowing full well it was against the law."

Warrington Crown Court had heard that McGibbon first made contact with the girl over the Internet and they arranged to meet up.

Prosecuting, Laura Edmunds told the court McGibbon first had unprotected sex with the girl 'reasonably believing she was at least 16, possibly 17-years-old'.

It was then that the pair, fearing an unplanned pregnancy, visited a Liverpool family planning clinic, where the 13-year-old claimed she was 15.

McGibbon continued a relationship with the girl now believing she was 15.

They had protected sex on two occasions at his home address in Baker Road, Weston Point, Runcorn.

It was only when the 13-year-old's mother heard from fellow parents about the sexual incidents, that police were informed and McGibbon arrested.

Defending, Simon Berkson said that sex between McGibbon and the girl was always consensual and his client had embarked on the relationship 'reasonably believing' she was at least 16.

But Mr Bush told McGibbon: "There is no doubt that on the two occasions I am concerned with, you were well aware she was under 16.

"Had it not been for the girl's friend telling her mum and so on, there is no reason to suggest you would not have carried on committing further offences until she reached 16."

McGibbon was placed on the sex offender's register for ten years.
